Welcome to Kompeaa! These Terms of Service (“Terms”) govern your access to and use of the Kompeaa website, mobile applications, and other products and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

  1. Account Registration
  • You must create an account to access and use certain features of the Services.
  • You agree to provide accurate, current, and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your account credentials and restricting access to your account.

2. Use of the Services

  • You agree to use the Services only for lawful purposes and in accordance with these Terms.
  • You will not share your account credentials or allow others to access or use the Services under your account.
  • You will not upload, transmit, or distribute any content that is illegal, defamatory, threatening, harassing, hateful, or otherwise objectionable.

3. Job Postings and Applications

  • Employers may post job listings on the Services, and job seekers may apply for those listings.
  • Kompeaa does not guarantee the accuracy or completeness of job listings or the suitability of applicants.
  • You are solely responsible for conducting your own due diligence and verifying information related to job postings and applicants.

4. Candidate Resumes and Data Handling

  • Job seekers may upload resumes and other personal information to the Services when applying for job listings.
  • By submitting your resume or personal information, you grant Kompeaa a limited license to use, store, and share your information with potential employers on the Services.
  • Kompeaa will handle your personal information in accordance with our Privacy Policy and applicable data protection laws.

5. User Content

  • Kompeaa does not claim ownership of any content (including resumes, cover letters, and job listings) that you upload, submit, or transmit through the Services (“User Content”).
  • By submitting User Content, you grant Kompeaa a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display the User Content in connection with operating and promoting the Services.

6. Third-Party Services

  • The Services may contain links to or integrations with third-party websites, applications, or services.
  • Kompeaa does not endorse or assume any responsibility for third-party services.
  • Your use of third-party services is at your own risk and subject to their terms and policies.

7. Intellectual Property

  • The Services and all associated content, features, and functionality are owned by Kompeaa and its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
  • You may not modify, reproduce, distribute, create derivative works of, publicly display, or in any way exploit the Services or associated content without Kompeaa’s prior written consent.

8. Privacy

  • Your use of the Services is subject to Kompeaa’s Privacy Policy, which is incorporated into these Terms by reference.

9. Termination

  • Kompeaa reserves the right to terminate or suspend your access to the Services, with or without notice, for any reason, including if Kompeaa believes you have violated these Terms.

10. Disclaimer of Warranties

  • The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied.
  • Kompeaa does not warrant that the Services will be uninterrupted, error-free, or secure.

11. Limitation of Liability

  • Kompeaa will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
  • Kompeaa’s total liability to you for any claims arising out of or related to these Terms or the Services will not exceed the amount you have paid Kompeaa, if any, in the 12 months preceding the claim.

12. Indemnification

  • You agree to indemnify, defend, and hold harmless Kompeaa and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your violation of these Terms or your use of the Services.

13. Governing Law and Dispute Resolution

  • These Terms will be governed by and construed in accordance with the laws of Kenya.
  • Any disputes arising out of or related to these Terms or the Services will be resolved through binding arbitration in Kenya, except that Kompeaa may seek equitable relief in any court of competent jurisdiction.

14. Changes to These Terms

  • Kompeaa reserves the right to modify these Terms at any time.
  • Your continued use of the Services after any modifications constitutes your acceptance of the updated Terms.

15. Miscellaneous

  • These Terms constitute the entire agreement between you and Kompeaa regarding the Services and supersede any prior agreements or understandings, whether written or oral.
  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

By accessing or using the Services, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not access or use the Services.
